An ordinance correcting (1) Specific Use Permit No. 2558 established by Ordinance No. 32811; (2) Planned Development District No. 840, established by Ordinance No. 28104; and (3) Planned Development District No. 1052, established by Ordinance No. 31859 - Financing: No cost consideration to the City

BACKGROUND

On August 14, 2024, the City Council approved Ordinance No. 32811 for a new Specific Use Permit No. 2558; on property located on the south line of Elm Street west of Crowdus Street, to allow a bar, lounge, or tavern use on property zoned Tract A within Planned Development District No. 269 (Deep Ellum/Near East Side).

Subsequent, to the passage of the ordinance, it was discovered that the Specific Use Permit No. 2558 had previously been assigned to a different case number which was approved by City Council under Ordinance No. 32879 on September 25, 2024. The correction ordinance updates the latter Specific Use Permit No. 2585. No other corrections are proposed; however, associated site plan will also be updated with the corrected Specific Use Permit No. No. 2585.

On January 26, 2011, the City Council approved Ordinance No. 28104 for Planned Development District No. 840, on an area bounded by Gayglen Drive, Oklaunion Drive, Komalty Drive, and Longbranch Lane; on property zoned an R-7.5(A) Single Family District.

Subsequent to the passage of the ordinance it was determined that the Sec. 51P-840.110(b) inaccurately removed an exception permitting queueing and student drop-off/pick-up in the city rights-of-way.
