BACKGROUND

The Dallas Police Department seeks to enter into an Interlocal Aagreement with the Office of the District Attorney for Kaufman County, State of Texas ("Kaufman County DA's Office"), Criminal District Attorney's Office for the disposition of proceeds from contraband forfeited pursuant to Chapter 59 of the Texas Code of Criminal Procedure (TCCP). The provisions of tThis Interlocal Aagreement sets forth the percentage amounts to be received by each party to the Agreement, within the contect of differing sets of circumstances, of proceeds from contraband which has been seized and forfeited pursuant to as defined herein that is seized and forfeited under Chapter 59 of the Texas Code of Criminal Procedure. Three such sets of circumstances addressed within this Interlocal Agreement are as follows: TCCP,

1. Where if no aAnswer is filed in the case, the Dallas Police Department will receive seventy percent (70%) and the Kaufman County Office District Attorney will receive thirty percent (30%) of the value of these forfeitedure of contraband, which applies to currency, real property, collectibles, documents representing things of value, precious metals, and personal property.
