BACKGROUND
This item authorizes the second step of acquisition for condemnation by eminent domain to acquire a wastewater easement containing approximately 20,987 square feet of land for the FM01 Five Mile Creek Interceptor Project. This project will facilitate the construction of an estimated 14,700 feet of 72 and 84-inch wastewater mains along Five Mile Creek.
On April 8, 2026, by Resolution No. 26-0620, the first resolution approved, authorized the purchase in the amount of $34,104.00, based upon an independent appraisal. The property owner declined the City's first offer, and it is now necessary to authorize acquisition by eminent domain. There are no relocation benefits associated with this acquisition.
The mains targeted for installation were identified in the Comprehensive Wastewater Collection System Assessment Update based on capacity improvement needs. Future construction of the proposed mains will increase wastewater system capacity to meet existing and future projected peak demands, reduce sanitary sewer overflows, and reduce maintenance costs.
