BACKGROUND

 

The Dallas Police Department seeks to enter an agreement with the District Attorney’s Office of Denton County for disposition of proceeds from contraband forfeited pursuant to Chapter 59 and Article 18.18 of the Texas Code of Criminal Procedure (TCCP).

 

The provisions of this agreement as defined herein that is seized and forfeited under Chapter 59 and Article 18.18, TCCP. DPD shall retain 80% of all forfeited property and the proceeds from the sale thereof, to be used for official law enforcement purposes, and the Attorney Representing the State shall retain 20% of all forfeited property and the proceeds from the sale thereof.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On August 26, 2009, the City Council authorized an interlocal Agreement with the Denton County Criminal District Attorney to share an eighty/twenty percent split of the proceeds received by the Denton County Criminal District Attorney for cash, negotiable instruments, or income from the sale of all contraband forfeited under Chapter 59 of the Texas Code of Criminal Procedure beginning September 1, 2009, by Resolution No. 09-2094.
