BACKGROUND

The Dallas Symphony Orchestra (DSO) has submitted a park naming application to the Dallas Park & Recreation Department to formally rename Betty B. Marcus Park to Shirley and Bill McIntyre Park.

DSO will enter into a ten-year maintenance and operations Agreement with a five-year renewal option with the City to fund park improvements, including providing enhanced grounds maintenance.

Deal Points (including but not limited to):

* The City of Dallas Park and Recreation agrees to:
o Permit DSO to enter premises to maintain the areas they have selected, by using hand and power tools, all in coordination with a City of Dallas Park & Recreation Department Certified Arborist and the District Manager.
* The Dallas Symphony agrees to:
o At its own cost, supplement the general maintenance/landscaping at a cost of $50,000.00 in year one and $25,000.00 - $30,000.00 annually after year one until the expiration of the agreement; this includes additional planting of additional flowers, additional cleaning and pruning beyond what the city has traditionally done in recent years.

o At its own cost, be responsible for the repair of the stonework, upgrade pathways and ensure safety at a cost of $100,000.00 in year one.
