BACKGROUND

This item authorizes the second step of acquisition for condemnation by eminent domain to acquire eleven parcels for a total of approximately 78,483 square feet of land (list attached to the Agenda Information Sheet) located near the intersection of Pontiac Street and Cadillac Drive for the Cadillac Heights Phase II Project. The properties are encumbered with title issues, and/or owners who have declined the City's offer to acquire. The City will not be able to close the transactions amicably.

The parcels will be used for City service and maintenance facilities. The considerations are based on independent appraisals.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

On August 25, 2021, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Payless 4 More, LLC of approximately 7,600 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 21-1362.
