Authorize the second step of acquisition for condemnation by eminent domain to acquire a wastewater easement containing approximately 4,443 square feet of land from Joseph Jones et. al, located near the intersection of South Lancaster Road and Arden Road for the FM01 Five Mile Creek Interceptor Project - Not to exceed $9,109.00 ($6,109.00, plus closing costs and title expenses not to exceed $3,000.00) - Financing: Wastewater Construction Fund

BACKGROUND
This item authorizes the second step of acquisition for condemnation by eminent domain to acquire a wastewater easement containing approximately 4,443 square feet of land from Joseph Jones et. al, located near the intersection of S. Lancaster Road and Arden Road for the FM01 (PID6559) Five Mile Creek Interceptor Project. This project will facilitate the construction of an estimated 14,700 feet of 72 and 84-inch diameter wastewater mains along Five Mile Creek.
On May 13, 2026, the City Council authorized the purchase of a wastewater easement in the amount of $6,109.00, based upon an independent appraisal by Resolution No. 26-0810. The property owner declined the City's offer, and it is now necessary to authorize acquisition by eminent domain. There are no relocation benefits associated with this acquisition.
The mains targeted for installation were identified in the Comprehensive Wastewater Collection System Assessment Update based on capacity improvement needs. Future construction of the proposed mains will increase wastewater system capacity to meet existing and future projected peak demands, reduce sanitary sewer overflows and reduce maintenance costs.
