Authorize a Multiple Use Agreement with the Texas Department of Transportation permitting the use of right-of-way for operation and maintenance of the pedestrian crossing from the Dallas Area Rapid Transit Victory Station to the Interstate Highway 35E Southbound Frontage Road - Financing: No cost consideration to the City

BACKGROUND
On August 13, 2020, the Regional Transportation Council approved project funding to construct a pedestrian crossing beneath Interstate Highway (IH) 35E connecting the Dallas Design District to the Dallas Area Rapid Transit (DART) Victory Station. The project was approved as part of the North Central Texas Council of Government's (NCTCOG) COVID-19 Infrastructure Program. Design and construction of the project is fully funded by NCTCOG. The City of Dallas is not required to contribute a local match, as the Texas Department of Transportation (TxDOT) is leading the implementation of the project.
The project is scheduled for letting in Fall 2024. The scope of work includes construction of a crosswalk with pedestrian hybrid beacon across the IH-35E Southbound Frontage Road, a pedestrian trail, lighting, and landscaping.
The project will provide a safer pedestrian mid-block crossing at the IH-35E Southbound Frontage Road and will result in upgrades to the existing unimproved path and enhanced safe connection from the west side of IH-35E/Design District to DART's Victory Station and the American Airlines Arena area on the east side of IH-35E.
The City agrees to manage the operation and maintenance of the pedestrian infrastructure, deeming it necessary to execute a Multiple Use Agreement (MUA) with TxDOT. This MUA will allow the use of certain right-of-way to perform operation...
