Authorize the (1) application and acceptance of the Texas School Safety Center Tobacco Enforcement Grant in the amount of $43,750.00 from Texas State University for the purpose of reducing youth access to tobacco products and to ensure accordance with Chapter 161, Texas Health and Safety Code for the period January 1, 2020 through August 31, 2020; (2) establishment of appropriations in an amount not to exceed $43,750.00 in the FY20 Tobacco Enforcement Program Fund; (3) receipt and deposit of grant funds in an amount not to exceed $43,750.00 in the FY20 Tobacco Enforcement Program Fund; and (4) execution of the interlocal cooperation contract and all terms, conditions, and documents required by the grant contract - Not to exceed $43,750.00 - Financing: Texas School Safety Center Grant Funds

BACKGROUND
The Texas School Safety Center Tobacco Enforcement Grant provides funding to support the enforcement and the reporting of tobacco compliance activities for the purpose of reducing youth access to tobacco products. The grant activities include retailer controlled buys ("stings"), to ensure compliance with the Texas Health and Safety Code, Chapter 161, Sec. 161.082 - sale of cigarettes, e-cigarettes or tobacco products to persons younger than 21 years of age prohibited: Proof of age required.
Ongoing and consistent enforcement initiatives that involve on-site compliance inspections of cigarette or tobacco retail outlets will be required by law enforcement officers and may result in the issuance of citations.
The funding agency requires monthly enforcement activity reports and financial status reports to be provided to the Texas School Safety Center contractor for the Texas State University System.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On August 24, 2016, City Council authorized the application and acceptance of the Texas Safety Center 2016/2017 Tobacco Enforcement Grant by Resolution No. 16-1341.
