An ordinance amending (1) Chapter 47A, “Transportation for Hire,” of the Dallas City Code by amending Sections 47A-1.5, 47A-1.6, 47A2.1.2, 47A-21.8, 47A-2.2.4, 47A-2.2.7, 47A-2.2.8, 47A2.2.9, 47A-2.3.1, 47A-2.3.3, 47A-2.4.7, 47A2-.5.2, and 47A-3.2 to (a) modify definitions; (b) modify and delete certain fees; (c) modify operating authority application requirements; (d) clarify driver permit requirements; (e) clarify driver permit investigations; (f) modify the driver permit expiration; (g) provide additional requirements for displaying a driver permit; (h) provide additional requirements to obtain vehicle permits; (i) modify vehicle quality standards; (j) delete signage requirements; (k) modify minimum insurance limits; (l) make certain grammatical corrections as needed; (m) provide a penalty fee not to exceed $500.00; (n) provide a saving clause; (o) provide a severability clause; and (p) provide an effective date; and (2) Chapter 5, “Aircraft and Airports”, of the Dallas City Code to (a) provide regulations for airports generally, transportation services at airports, customer facility charges, terminal and facility, and operations and security; (b) provide a penalty not to exceed $500.00; (c) provide a saving clause; and (d) provide an effective date - Financing: No cost consideration to the City

BACKGROUND

 

This proposed action proposed is in response to transportation for Hhire stakeholder’s meetings on March 19th and 21st of 2019; the Department of Aviation’s two-year review of its ordinance; and the City Auditor recommendation to evaluate the City’s processes to regulate and enforce taxicab and transportation network drivers and companies to ensure compliance with City Code, regulations, and fees.

 

At the transportation for hire stakeholder meetings conducted by AVI-Transportation Regulation, they requested that an increase of fees to be incorporated for cost recovery; adjust for hire insurance requirements that are equitable to market competition on a state and local level; and remove language associated with transportation network companies that are currently governed by the State of Texas.

 

 

The Department of Aviation conducted a two-year internal review of its ordinance and discovered that specific activities, regulations, and practices were no longer applicable.  Therefore, efforts were made to modify and streamline language to be current with activities, regulations, international fees, and practices of a public airport the size of Dallas Love Field in today’s aviation marketplace.

 

On August 24, 2020, the City Auditor briefed the Government Performance and Financial Management Committee and recommended that the Department of Aviation perform verification on at least 25 percent of the transportation for hire company’s websites on a quarterly basis; establish data sharing agreements with transportation network companies to obtain detailed airport trip fee activity reports; and request airport trip fee reports with sufficient information to perform revenue assurance analysis.  Other changes contained in the proposed ordinances include, but are not limited to, changes to definitions, enforcement, policy, and special events.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

August 28, 2013, City Council remanded consideration of transportation-for-hire service regulations to the Transportation and Trinity River Project Committee by Resolution No. 13-1509.

 

The Transportation and Trinity River Project Committee was briefed on transportation-for-hire service regulations on January 13, 2014.

 

The Transportation and Trinity River Project Committee held a special meeting to hear vendor presentation, receive public comments, and discuss transportation-for-hire service regulations on January 21, 2014.

 

The Transportation and Trinity River Project Committee was briefed on proposed amendments to the transportation-for-hire service regulations on January 24, 2014.

 

The Transportation-for-Hire Workgroup met to discuss amendments to the transportation-for-hire service regulations on March 4, April 25 and May 6, 2014.

 

The Transportation and Trinity River Project Committee was briefed on the proposed amendments to the transportation-for-hire service regulations submitted by the Transportation-for-Hire Workgroup, and moved to forward the amendments to the full council for consideration and comment, and then to establish a public forum and comment period on May 27, 2014.

 

The City Council was briefed on the proposal amendments to the transportation-for-hire service regulations submitted by the Transportation-for-Hire Workgroup on August 6, 2014.

 

The Transportation and Trinity River Project Committee was briefed on the revised transportation-for-hire ordinance on September 8, 2014.

 

The Transportation and Trinity River Project Committee was briefed on the transportation-for-hire ordinance on November 17, 2014.

 

On December 10, 2014, City Council authorized the transportation-for-hire ordinance by Resolution No. 14-2203; Ordinance No. 29596.

 

The Economic Development Committee was briefed on Rental Car Operations on May 2, 2016.

 

On September 14, 2016, City Council authorized the amendment of Chapter 47A Transportation for Hire of the Dallas City code by Resolution No. 16-1439; Ordinance No. 30180.

 

The Mobility Solutions, Infrastructure and Sustainability Committee was briefed on the Customer Facility Charge on August 28, 2017.

 

The Mobility Solutions, Infrastructure and Sustainability Committee was briefed on Dallas Love Field General Aviation Landing Fee on October 9, 2017.

 

City Council was briefed by memorandum regarding an upcoming agenda item to amend Chapter 5 Aircraft and Airports of the Dallas City Code to be presented on June 22, 2018 regarding Dallas Love Field General Aviation Landing Fee on April 17, 2018.

 

The Mobility Solutions, Infrastructure and Sustainability Committee was briefed by memorandum regarding Chapter 5 amendments on April 23, 2018.

 

City Council was briefed by memorandum regarding an amendment to Chapter 5 Aircraft and Airports of the Dallas City Code was presented the Dallas City Council regarding Dallas Love Field General Aviation Landing Fee on June 22, 2018.
