BACKGROUND

 

This item authorizes amending Ordinance No. 28771, previously approved on September 12, 2012, which licensed a portion of an alley near the intersection of Tenth Street and Madison Avenue to Homeward Bound Inc. The license was assigned to UG Melba, LLC on July 18, 2018. UG Melba, LLC is requesting an amendment to the license to: (1) add a new paragraph for obligation of required conditions as a new Section 7 and renumbering; (2) substitute a new Exhibit A; and (3) add a new Exhibit C for the use of approximately 200 square feet of land to maintain and utilize a pedestrian skybridge over and above a portion of alley near its intersection with Tenth Street. The use of this area will not impede pedestrian or vehicular traffic. This license has a remaining term of 31 years.

 

The licensee will indemnify the City and carry general liability insurance naming the City as an additional insured.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On September 12, 2012, City Council authorized renewal of a private license to Homeward Bound Inc. for the use of approximately 200 square feet of land to maintain and use the existing overhead corridor in an alley right-of-way located near the intersection of Tenth Street and Madison Avenue by Resolution No. 12-2274;  Ordinance No. 28771.
