BACKGROUND

 

The City of Dallas and University Crossing Public Improvement District (UCPID) partnered in application for 2017 Transportation Alternatives Set-Aside (TASA) Program for the Ridgewood Trail Lighting Project (Project). On September 6, 2019, the Park and Recreation Board renamed a portion of the Ridgewood Trail to University Crossing Trail and subsequently, the project was renamed to the University Crossing Trail Lighting Project. The application required that the applicant be a governmental body and that the applicant provide a match of 20 percent of the total cost of the Project. In July 2017, the City of Dallas was successful in application for all costs requested of the Project. The total project cost is estimated to be $1,024,444.00. TASA funds awarded are $687,280.00 and State participation is $41,769.00. The City is required to provide $295,395.00 in matching funds which includes payment to the Texas Department of Transportation (TxDOT) of $27,335.00 (An initial payment of $19,525.00 is due to the State after the Advanced Funding Agreement with the state is executed.) for plan review and other services in accordance with the TASA Program requirements.

 

 

 

 

 

UCPID is agreeable to fully funding the required matching funds. Should any costs be found to be ineligible, or the project cost exceed the estimated total project cost, the applicant is required to fund such overages-for this reason UCPID is also providing $500,000.00 additional funds, should they be needed, for such potential additional costs (Total UCPID funding: $295,395.00+$500,000.00=$795,395.00). UCPID is agreeable to funding such potential overages so that the project has no cost consideration to the City.

 

The agreement will be subject to the following terms:

 

1.                     The agreement shall terminate upon completion of the Project. All improvements to the trail shall become property of and maintained and operated by the City.

 

2.                     Both parties recognize that the City’s trail improvement area is within a trail easement on Dallas Area Rapid Transit land and subject to the terms of the easement. A portion of the trail is also located on Oncor land and is subject to the City’s license agreement with Oncor.

 

3.                     UCPID is responsible for all costs required for the Project. All costs not covered by the TASA Program funds will be provided by UCPID. Should the City’s total project costs exceed, or be projected to exceed $795,395.00, UCPID has the right to terminate the agreement with thirty-days’ notice to the City. City has the right to terminate the agreement with ten-day’s notice for cause or for convenience. In such case that the agreement is terminated, the City’s remedy shall be the right to either appropriate City funds, by separate City Council action, for the project, or terminate the Advanced Funding Agreement (AFA)-the City has the right to terminate the AFA should the City not appropriate funds for the project.

 

4.                     The City will be the project lead and will execute all TASA Program required agreements with TxDOT, will manage the project, and will bid and manage construction of the project (Approval of the AFA is by separate City Council action.). In collaboration with the City, UCPID has hired and funded the cost of a consultant to design the project and provide documentation, assessments, clearances, etc. to TxDOT as required by the AFA.

 

5.                     In addition to financial support, UCPID will support the City by providing all prior studies, design and revisions of construction plans, environmental reviews, and all other prior and construction-related design and professional consultation work required of the Project, other investigations in support of the Project, and make available UCPID staff and its consultants for meetings, presentation, etc. as needed and required by the City.

 

6.                     Upon execution of the agreement, UCPID will transfer funds in the amount of $295,395.00. UCPID will transfer additional funds to the City, should they be required for the Project, in the amount of $500,000.00, in accordance with the terms of the agreement, for a total amount not to exceed $795,395.00.

On January 14, 2021, the Park and Recreation Board authorized an Advance Funding Agreement with the University Crossing Public Improvement District for matching funds for the 2017 Transportation Alternatives Set-Aside Program for the University Crossing Trail Lighting Project at Glencoe Park located at 3700 Glencoe Street to Skillman Street.
