BACKGROUND

 

Plaintiffs Terrance Bass, Barry Boyd, Elizabeth Lopez, and Joseph Scott filed a lawsuit against the City of Dallas on December 8, 2017, individually and on behalf of all others similarly situated.  The lawsuit alleged that hourly employees were not paid overtime for work they performed in excess of 40 hours a week and that hourly employees were not paid for work during their lunch breaks and after hours.  The federal judge presiding over the case decided that the named plaintiffs could pursue a collective action for certain Code Compliance Services employees.  Approximately 80 current and former Code employees joined the lawsuit.+

City Council was briefed in Executive Session regarding this matter on May 6, 2020, and by confidential memorandum on January 23, 2021, and February 8, 2021.
