Authorize an Interlocal Agreement between County of Ellis District Attorney’s Office and the Dallas Police Department pursuant to Chapter 59 of the Texas Code of Criminal Procedure - Financing: No cost consideration to the City

BACKGROUND
The Dallas Police Department seeks to enter an agreement with Ellis County District Attorney’s Office for disposition of proceeds from contraband forfeited pursuant to Chapter 59 of the Texas Code of Criminal Procedure (TCCP).
The provisions of this agreement as defined herein that is seized and forfeited under Chapter 59, TCCP. If there is a default judgment filed, the Dallas Police Department will receive 70%, and the District Attorney will receive 30% of current money from the sale of forfeited property. If no default judgment filed, the Dallas Police Department will receive 60%, and the District Attorney will receive 40% of current money from the sale of forfeited property. If a trial commences, the Dallas Police Department will receive 50%, and the District Attorney will receive 50% of current money from the sale of forfeited property.
