BACKGROUND

 

On October 28, 2020, City Council authorized the execution of 34 contracts for the FY 2020-21 Cultural Organizations Program (COP) which provides a full year of cultural services for Dallas residents and visitors by established Dallas-based non-profit cultural organizations by Resolution No. 20-1697.

 

The resolution included a one-time payment of $150,000.00 for supplemental cultural services to advance the Dallas Cultural Plan 2018 and upon proof of private matching funds of $150,000.00, and a one-time exception to the funding level restrictions in the program guidelines to allow for this payment.

 

The ongoing effects of COVID-19 and of the 2021 winter storm, including damage to the theater following the storm, has impacted the organization’s ability to raise the required private match and deliver the supplemental cultural services by the original contract end date of September 30, 2021. The vendor has requested, and staff recommends, extending the term of the contract by one year to September 30, 2022.

 

In addition, the vendor has requested, and staff recommends, that the supplemental funds of $150,000.00 be paid in two portions of $75,000.00 each, upon delivery of supplemental cultural services and proof of private match for each $75,000.00.

 

Due to the proposed contract extension beyond FY 2020-21, funding for the supplemental services in the amount of $150,000.00 is proposed to be split between the Office of Arts and Culture FY 2020-21 General Fund appropriation and the Office of Arts and Culture FY 2021-22 General Fund, pending appropriations.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On February 26, 2020, City Council authorized and established the Cultural Organizations Program within the Office of Arts and Culture to support cultural services in the City of Dallas and approved the program guidelines by Resolution No. 20-0327.

 

On June 24, 2020, City Council approved the amended FY 2020-21 COP Guidelines due to COVID-19 impacts on planning for cultural events by Resolution No. 20-0991.

 

On August 10, 2020, the Allocations Committee of the Arts and Culture Advisory Commission approved a recommendation in support of the FY 2020-21 COP funding allocations.

 

On September 13, 2020, the Arts and Culture Advisory Commission unanimously approved a recommendation in support of alternate FY 2020-21 COP contracts to reflect FY 2020-21 updated budget proposals to increase the Cultural Organizations Program budget.

 

On October 19, 2020, the Quality of Life, Arts and Culture Committee voted to increase the COP contract funding for Bishop Arts Theatre Center by $150,000.00 to further advance the goals of the Dallas Cultural Plan, to require a private match of $150,000.00 from Bishop Arts Theatre Center, and to amend the COVID-19 Guidelines: FY 2020-21 Cultural Organizations Program to provide for a one-time exception to the funding level restrictions in the program guidelines to allow for this increase.

 

On October 28, 2020, City Council authorized the FY 2020-21 Cultural Organizations Program Contracts for the period October 1, 2020 through September 30, 2021 and amended the FY 2020-21 COP Guidelines to provide for a one-time exception to the funding level restriction for TeCo Theatrical Productions, Inc. d/b/a Bishop Arts Theatre Center by Resolution No. 20-1697.

 

FISCAL INFORMATION

 

Change of funding timing for payment to close out the project is a no cost consideration to the City.
