Title
Authorize an increase in the construction services contract with TDIndustries to provide heating, ventilation and air conditioning system installation and services at City facilities, through the National Cooperative Purchasing Alliance Contract No. 02-92 - Not to exceed $5,600,000.00, from $22,400,000.00 to $28,000,000.00 - Financing: Coronavirus State and Local Fiscal Recovery Funds ($4,000,000.00) and Capital Construction Fund ($1,600,000.00) (subject to annual appropriations)

BACKGROUND
This action will authorize Change Order No. 1, increasing the heating, ventilation and air conditioning system installation and services contract with TDIndustries by 25%. This contract was established for (1) COVID-19 related retrofits of building mechanical systems for 2020 using federal Coronavirus Aid, Relief, and Economic Security Act funding; and (2) installation, services and related products in support of the Building Services Department’s operation and management of over 480 facilities comprising over 10 million square feet.
This contract provides for updating mechanical systems at City facilities with high-efficiency equipment, retrofitting systems to improve air quality and reduce the transmission of air-born bacteria, viruses and fungi, system repairs and related products and services.
The Texas Local Government Code, Chapter 271, Subchapter F, Section 271.102, authorizes a local government to participate in a Cooperative Purchasing Program with another local government or a local cooperative organization. TDIndustries, Inc. was chosen from the National Cooperative Purchasing Alliance, Contract No. 02-92.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On April 22, 2020, City Council authorized the acceptance of the CARES Act and the Coronavirus Relief Funds (CRF) to aid the COVID-19 response throughout the City by Resolution No. 20-0644.
On June 17, 2020, City Council was briefed on the proposed uses of CARES and CRF funds to facilitate assistance to eligible communities and households economically impacted by COVID-19.
On October 28, 2020, City Council authorized a three-year construction contract for heating, ventilation and air conditioning system installation and services at City facilities with TDIndustries by Resolution No. 20-1676.
On June 23, 2021, City Council authorized the acceptance of grant funds from the U.S. Department of Treasury for the Coronavirus Local Fiscal Recovery Fund to provide relief during the ongoing COVID-19 pandemic by Resolution No. 21-1149.
On September 22, 2021, City Council authorized the final reading and adoption of the appropriation ordinance for the FY 2021-22 City of Dallas Operating, Capital, and Grant & Trust Budgets, which included the ARPA funds from the U.S. Department of Treasury for the Coronavirus Local Fiscal Recovery Funds by Resolution No. 21-1590.
