BACKGROUND

 

The City’s stormwater permit requires control of the quality of stormwater discharged within the City.  Specifically, the permit requires implementation of programs to collect and recycle, reuse, or properly dispose of Household Hazardous Waste (HHW) and to make those programs available to the residential sector.  This program meets those permit requirements and prevents collected HHW from being improperly disposed of and entering the storm drainage system, including local and regional creeks, streams, rivers, and lakes.

 

Since FY 1994-95, Dallas County, with support from area cities, has taken an active role in addressing the safe disposal of HHW regionally.  The City of Dallas (the City) is one of the cities which participate in the Dallas Area HHW Network, a consortium of 16 participating Dallas County cities.  The participating cities enter into an interlocal agreement, or renew an existing one, with Dallas County each year.  The City’s current five-year (initial year with four 1-year renewal options) interlocal agreement will be expired at the end of FY 2021-22. This agenda item seeks approval to enter into a new interlocal agreement for FY 2022-23, with options to renew for four additional years, consistent with Dallas County’s terms for an interlocal agreement with participating cities.

 

The Dallas County HHW program has been established for 28 years, with local citizen participation remaining consistent over the last two fiscal years.  In FY 2020-21, 26,150 county residents, including 14,083 from the City of Dallas, participated in the program and properly disposed of their automotive fluids, pool and yard chemicals, paint products, cleaning solvents, and other household hazardous chemicals at the County's Home Chemical Collection Center facility or at one of the HHW community events, including the City of Dallas mobile community BOPA (batteries, oils, paints, antifreeze) collection events, held throughout the year.

 

In FY 2020-21, 14,083 residents participated, with approximately 633 tons of household hazardous waste collected, making it one of the most successful years in program history.   Proper disposal or recycling prevents these pollutants from entering the stormwater drainage system, being disposed of in landfills, being illegally dumped or ending up in unauthorized dump sites.

 

The Dallas County HHW program budget for the current fiscal year is $1,938,475.00.  The County is projecting a 5% increase for the next fiscal year; which will yield a $2,042,326.00 annual program budget for FY 2022-23.  The increase is mainly related to the County’s program personnel compensation increase and the increases in contracted disposal service and temp labors.  The County anticipates program costs to continue to rise and will adjust accordingly, based on participation.  The City's costs include a percentage for County overhead, disposal based on resident participation, and County staffing support at BOPA (battery, oil, paint, and antifreeze) collection events.

 

If current usage and disposal cost trends continue, the City expects to expend $1,171,900.00 in FY 2022-23 that include $391,779.00 for the City’s share of the HHW program operational and capital budget and the rest is for the projected disposal cost that will be invoiced monthly by Dallas County based on the actual participation of City of Dallas residents during the month. For the four renewal option years of FY 2023-24, FY 2024-25, FY 2025-26, and FY 2026-27, an annual budget increase of up to 7% may be applied, with adequate budget documentation from the County.  The interlocal agreement renew and annual budget are subject to appropriation in annual budget adoption.

On August 24, 1994, City Council authorized first HHW Interlocal Agreement established with Dallas County by Resolution No. 94-3064.

 

On December 13, 2017, City Council authorized the current Interlocal Agreement with Dallas County by Resolution No. 17-1843.
