BACKGROUND

On June 25, 2003, the City entered into a multi-year agreement with Texas Discovery Gardens (a non-profit organization) to manage and operate the Discovery Gardens building and surrounding grounds at Fair Park for a 10-year period. The agreement was extended on November 7, 2013 for a 10-year period. The agreement with Texas Discovery Gardens requires the execution of a separate funding contract to authorize the stipends payable during the current year.

On October 24, 2018, City Council authorized a management contract with Fair Park First for management and operation of Fair Park for the Park & Recreation Department for a term of 20 years, with 25-year extension options by Resolution No. 18-1531, which included an assignment of the underlying agreement with Texas Discovery Gardens to Fair Park First. However, the assigned contract does not contain a funding provision for community outreach and other related programming services.

On June 9, 2021, City Council authorized the first supplemental agreement with Fair Park First, to amend the agreement in the interest on enhancing, promoting and improving Fair Park by Resolution No. 21-1017, which included that the City shall be solely responsible for funding any operating grants, utility reimbursements, and other annual subsidies including any annual stipends.
