Title
Authorize a twenty-four-month construction services contract for the 2024 Sidewalk and Barrier Free Improvements at Various Locations that includes water and wastewater adjustments at various locations throughout the City - Vescorp Construction, LLC dba Chavez Concrete Cutting, lowest responsible bidder of five - Not to exceed $4,319,525.00 - Financing: General Fund ($2,000,000.00), 2024 Certificate of Obligation ($999,000.00), Coronavirus State and Local Fiscal Recovery Funds ($1,158,475.00), Water Construction Fund ($147,050.00), and Wastewater Construction Fund ($15,000.00)

BACKGROUND
Coronavirus State and Local Fiscal Recovery Funds are eligible within the Qualified Census Tract areas to improve various intersections to promote the safety of all right-of-way users including motorist, cyclists, and pedestrians.
On July 26, 1990, the Americans with Disabilities Act (ADA) was signed into Federal Law. Title II of the ADA specifically applies to state and local governments and stipulates that no qualified individual with a disability shall, by such disability be excluded from participation in or be denied the benefits of the services, programs or activities of a public entity, or be subject to discrimination by any public entity. Public entities with fifty or more employees are required to develop a transition plan that comply with all requirements of the law.
This action will authorize a twenty-four-month sidewalk and barrier free ramp installation paving services contract for the Sidewalk and Barrier Free Ramp Program. The installation of barrier free ramps throughout the City is required in order to be in compliance with the ADA. Projects being implemented with this contract include the Infrastructure Management Program, 2017 Bond and 2024 Bond Program Sidewalk Improvements. These projects will be constructed with funds from the FY 2023-2024 Infrastructure Management Program, 2012 Bond and 2017 Bond Program.
Vescorp Construction, LLC dba Chavez Concrete Cutting is a Dallas-based corporation, operating within the corporate city limits of Dallas, Texas.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On June 23, 2021, the City Council authorized the City Manager to (1) spend funds in compliance with the American Rescue Plan Act of 2021 and in accordance with guidance from the U.S. Department of Treasury for the Coronavirus Local Fiscal Recovery Fund (CFDA No. 21.027); (2) take all necessary actions to apply for and receive funds for which the City is eligible from state and federal sources; (3) receive and deposit funds in an amount not to exceed $355,426,891.00 in the Coronavirus Local Fiscal Recovery Fund which will be received in two tranches with 50% in 2021 and 50% in 2022; (4) establish appropriations in an amount not to exceed $177,713,445.50 in the Coronavirus Local Fiscal Recovery Fund; (5) transfer appropriations, expenses, or cash between funds established for the coronavirus disease 2019 (COVID-19) response; and (6) execute any grant agreements necessary to receive COVID-19 funding from federal and state sources, in an amount not to exceed $355,426,891.00, by Resolution No. 21-1149.
On September 22, 2021, the City Council authorized the final reading and adoption of the appropriation ordinance for the FY 2021-22 City of Dallas Operating, Capital, and Grant & Trust Budgets, which included the ARPA funds from the U.S. Department of Treasury for the Coronavirus Local Fiscal Recovery Funds by Resolution No. 21-1590.
