BACKGROUND

This item authorizes the acquisition of an irregularly shaped, unimproved tract of land containing approximately 1,654 square feet from the Estate of Luther Yost. The property is located on Brookhaven Drive near its intersection at Interstate Highway 35 and will be used for the construction of erosion control improvements. The consideration is based on an independent appraisal. There are no relocation benefits associated for this acquisition.

Dallas Water Utilities is currently completing an emergency erosion control improvement along Brookhaven Drive. The roadway has been severely undercut by Cedar Creek, which poses a threat to the roadway traffic and requires emergency improvements to prevent any further erosion and potential harm to the public. The proposed gabion wall improvements fall within private property along the creek bank and an easement on this remnant tract is needed to prevent continuous erosion along the creek bank and to safeguard the integrity of Brookhaven Drive.
