BACKGROUND

 

On September 1, 2023, Senate Bill (SB) 577 became effective as passed into law by the 88th Texas Legislature and signed by Governor Greg Abbott on May 27, 2023. SB 577 prohibits local health departments from issuing a local food manager certificate or requiring a fee for issuance of the certificate.

The Ad Hoc Committee on Legislative Affairs was briefed on code amendments due to state legislation on August 14, 2023.

FISCAL INFORMATION

 

This item has no cost consideration to the City. Due to the state law change, revenue from the food manager certificate fee was not budgeted for FY 2023-24, therefore this action does not result in revenue foregone. Enforcement of the fine, not to exceed $500.00, may generate revenue to the City, estimated at $15,000.00.
